Please read carefully before registering your child for Cactus Kickers LLC programs.
1. Assumption of Risk and General Liability Waiver
By registering my child for Cactus Kickers LLC, I acknowledge and understand that participation in soccer activities involves inherent risks, including but not limited to physical injury, illness, or property damage. These risks may result from the actions of participants, coaches, staff, field conditions, equipment, or other factors.
I, on behalf of myself and my child, voluntarily assume all risks associated with participation in Cactus Kickers LLC programs, including practices, games, tournaments, and related activities.
I hereby release, waive, discharge, and hold harmless Cactus Kickers LLC, its directors, coaches, staff, volunteers, affiliates, and representatives from any and all liability, claims, demands, or causes of action for injuries, damages, or losses sustained by my child or myself during participation in program activities, except in cases of gross negligence or willful misconduct.
2. Medical Certification and Emergency Authorization
I certify that my child is in good physical health and is capable of participating in the soccer activities offered by Cactus Kickers LLC. I understand it is my sole responsibility to inform the program in writing of any medical conditions, allergies, disabilities, or special needs that may affect my child's safe participation.
In the event of a medical emergency, I authorize Cactus Kickers LLC staff and volunteers to:
Administer basic first aid
Seek emergency medical treatment for my child
Transport my child to a medical facility if necessary
Make reasonable medical decisions in good faith on my behalf if I cannot be immediately reached
I agree to assume full financial responsibility for any and all costs associated with medical treatment, including emergency care, ambulance services, and hospital charges. I release Cactus Kickers LLC, its staff, and volunteers from liability for any medical decisions made in good faith during an emergency situation.
3. Photo, Video, and Media Consent
I grant Cactus Kickers LLC permission to photograph, videotape, or otherwise record my child's participation in program activities. I authorize the use of my child's name, image, likeness, and voice in photographs, videos, or other media for promotional, marketing, educational, or informational purposes, including but not limited to:
Program website and social media platforms
Printed promotional materials and brochures
News releases and media coverage
Internal program documentation
I understand that:
My child's likeness may be used without compensation to me or my child
I will not be notified prior to use of such media
I waive any right to inspect or approve the finished product
Opt-Out Option: If I wish to opt out of this media consent, I understand I must notify Cactus Kickers LLC in writing at the time of registration or by emailing robdinnie@cactuskickers.com.
4. Code of Conduct and Behavioral Expectations
I agree that my child and I (as parent/guardian) will abide by the Cactus Kickers LLC Code of Conduct, which promotes:
Respect for coaches, staff, volunteers, referees, and other participants
Positive sportsmanship and team spirit
Safety and adherence to program rules and guidelines
Appropriate behavior on and off the field
I understand that failure to comply with program rules, including but not limited to disrespectful behavior, verbal or physical abuse, unsportsmanlike conduct, bullying, or failure to follow safety guidelines, may result in my child's suspension or permanent removal from the program without refund of fees paid.
I agree to:
Ensure my child arrives on time for scheduled activities
Provide timely pick-up of my child after activities
Supervise my child appropriately during non-structured program times
Communicate respectfully with coaches and staff
Support the program's mission and values
I release Cactus Kickers LLC from liability for incidents arising from my child's or my failure to follow program rules and expectations.
5. Payment and Refund Policy
I understand that registration fees are due at the time of enrollment and that my child's spot in the program is not guaranteed until payment is received in full. I acknowledge the program's refund policy and agree to its terms:
Before Season Start (30+ days): Full refund
•Before Season Start (15-29 days): 50% refund of registration fee
•Before Season Start (1-14 days): 25% refund of registration fee
•After Season Start: No refunds will be issued once the season has begun
Exceptions:
•Medical Withdrawal: If a player must withdraw due to injury or medical condition (with doctor’s note provided within 7 days), a prorated refund will be issued based on weeks remaining in the season, minus the $25 administrative fee
•Relocation: If family relocates more than 50 miles from the program area, a prorated refund will be issued with documentation, minus the $25 administrative fee
•Program Cancellation: Full refund if Cactus Kickers cancels the program
Non-Refundable Items: Uniform fees, equipment fees are non-refundable once ordered.
Refund Processing: All approved refunds will be processed within 14-21 business days.
6. Severability
If any provision of this agreement is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
